Welcome to Chip Buddies! The terms “we”, “us” and “our” refer to Chip Buddies. Chip Buddies operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Chip Buddies is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

Please read these Terms carefully — they include important info about your legal rights, including warranty disclaimers and limitations of liability (subject always to New Zealand law).

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy . If you don’t agree, please don’t use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm you are at least 18 years old (or the age of majority in your province/state), and you consent to any minor dependents using the Services on devices you own or manage.

To shop or browse, you may need to provide info like your email, billing, payment and shipping details. You promise all info you give is accurate, current and complete, and you have the right to provide it.

You’re responsible for keeping your account secure and for all activity under it. Don’t share, sell or transfer your account.

SECTION 2 - OUR PRODUCTS

We’ve done our best to show accurate product images and descriptions (love those curry-dusted chips pics!). But colours and appearance can vary depending on your screen/device settings.

We don’t guarantee the products will look or perform exactly as shown online.

Product descriptions can change without notice. We may discontinue products or limit quantities/regions at our discretion.

SECTION 3 - ORDERS

Placing an order is an offer to buy — we can accept or decline it for any reason. Your order isn’t accepted until we confirm it and process payment.

Review your order carefully before submitting. We may not be able to cancel or change accepted orders, but we’ll try to notify you via email/phone/address if we decline, modify or cancel.

Purchases are subject to our Returns & Refunds Policy [LINK].

You confirm purchases are for personal or household use only (not commercial resale/export).

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions can change without notice. The price is the one shown at order time (in your confirmation email). Prices exclude GST, shipping, handling, customs/import fees unless stated.

We may run separate promotions with their own terms.

Provide accurate payment/account info and update it promptly. You warrant your payment details are correct, you’re authorised to use them, and charges will be honoured (including taxes/shipping).

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates only — no guarantees. We’re not liable for delays from carriers, customs, weather, or events beyond our control. Risk and title pass to you once handed to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services (trademarks like Chip Buddies, logos, images of curry salt jars/sauce pouches, text, designs) are owned by us or our licensors and protected by NZ and international IP laws.

You can use the Services for personal, non-commercial purposes only. No copying, modifying, distributing or commercial use without our written permission.

Our names, logos, slogans are our trademarks — don’t use without permission. Shopify’s trademarks belong to Shopify.

SECTION 7 - OPTIONAL TOOLS

Third-party tools we provide access to (e.g., via Shopify apps) are “as is” with no warranties from us. Use at your own risk — check their terms.

Future features become part of the Services too.

SECTION 8 - THIRD-PARTY LINKS

We’re not responsible for third-party sites/links/content. Access at your risk. Direct complaints to them.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Chip Buddies is powered by Shopify. Sales are directly with us — Shopify isn’t responsible for transactions, products, or any issues. You release Shopify from related claims.

SECTION 10 - PRIVACY POLICY

Your info is handled per our Privacy Policy [LINK] and Shopify’s policy. By using the Services, you agree to these.

SECTION 11 - FEEDBACK

If you send ideas, reviews or feedback, you grant us a perpetual, royalty-free licence to use it (including commercially). You warrant you own it and it complies with these Terms. We can (but don’t have to) monitor/remove objectionable feedback.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We may correct typos, pricing/availability errors anytime (even post-order) without notice.

SECTION 13 - PROHIBITED USES

Use the Services lawfully only. No unlawful/malicious acts, IP infringement, harassment, spam, viruses, scraping, etc. We can suspend/terminate accounts for breaches.

SECTION 14 - TERMINATION

We can end your access anytime without notice. You remain liable for due amounts. Certain sections survive (e.g., IP, Feedback, Liability, Governing Law).

SECTION 15 - DISCLAIMER OF WARRANTIES

The Services and products are provided “as is” and “as available” to the extent permitted by law.

Nothing in these Terms excludes, restricts or modifies your rights under the Consumer Guarantees Act 1993 (CGA) or Fair Trading Act 1986 (FTA), which provide automatic guarantees that goods are of acceptable quality, fit for purpose, safe, match description, etc.

For consumer purchases (personal/household use), these statutory guarantees apply and cannot be excluded. Any disclaimers here apply only where the law allows.

We don’t guarantee uninterrupted, error-free access.

SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent permitted by law (including the CGA), we, our partners, Shopify etc. are not liable for indirect, consequential, punitive or special damages (lost profits, data loss etc.) from use of Services/products.

This doesn’t limit liability for CGA breaches or where law prohibits limitation.

SECTION 17 - INDEMNIFICATION

You indemnify us, Shopify etc. against losses/claims from your breach of these Terms, law violations, or misuse of Services.

SECTION 18 - SEVERABILITY

If any provision is invalid, the rest remain enforceable.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

No waiver if we don’t enforce a right. These Terms + policies are the full agreement.

SECTION 20 - ASSIGNMENT

You can’t assign without our consent. We can assign freely.

SECTION 21 - GOVERNING LAW

These Terms are governed by the laws of New Zealand. You and Chip Buddies submit to the non-exclusive jurisdiction of the courts of New Zealand.

For convenience only.

SECTION 23 - CHANGES TO TERMS

Check this page for updates. We’ll notify of material changes per law. Continued use = acceptance.
